My lease is ending. How do I get my deposit back?
When the lease ends, the landlord must return your deposit at the same time you hand the home back. If the money isn't ready, don't just move out: leaving can cost you the legal priority that protects your deposit. What to do 1. Give notice in time. The landlord must give notice 6 to 2 months before the end, and you at least 2 months before. If neither does, the lease renews automatically on the same terms. 2. Agree on the move-out date and any repair deductions in writing. Normal wear and tear isn't your cost; only damage you caused is. 3. If you're told you'll be paid when the next tenant moves in, don't move out without the deposit. If you must leave, apply to the court for a lease registration order (임차권등기명령) and move only after the registration is complete. It keeps your priority after you move. 4. Send content-certified mail (내용증명) asking for the deposit. 5. Ask a Lease Dispute Mediation Committee (adrhome.reb.or.kr) to mediate. 6. If that fails, apply for a payment order (지급명령) or file a lawsuit. Good to know • While you still live there, rent is still due and no late interest accrues. Late interest can be claimed after you've moved out and handed the home back (including after a lease registration order). • Free legal advice: Korea Legal Aid Corporation, 132.
