Can my landlord raise the rent or make me leave when the lease ends?
Usually you can stay 2 more years by using your one-time renewal right, and the rent or deposit can then rise by at most 5%. The landlord can refuse only for reasons the law lists. What to do 1. Between 6 and 2 months before the lease ends, tell the landlord clearly that you're using your right to request renewal (계약갱신요구권). Use a method you can prove later, such as a saved message or content-certified mail. 2. The renewed lease runs 2 years on the same terms, and any increase is capped at 5%. 3. After renewing, you can still leave at any time; the lease ends 3 months after the landlord gets your notice. Good to know • One reason the landlord may refuse is that they or their parents or children will really live there. If they then rent to someone else during the 2 years you would have stayed, you can claim damages. Full list: Easy Law. • If the landlord gives no notice 6 to 2 months before the end and you give none at least 2 months before, the lease renews automatically on the same terms. You can then leave with 3 months' notice, and your renewal right stays unused. • The 5% cap covers renewals using your right and increases during a lease; a new lease after the old one ends is set by agreement. • Disputes: a Lease Dispute Mediation Committee (adrhome.reb.or.kr).
